St John of God Health Care is pleased to provide you with internet access during your stay in our hospital.
Terms and Conditions for St John of God Health Care Free Guest WiFi
In these Terms and Conditions “SJGHC” means St John of God Health Care Inc (ARBN 051 960 911) on behalf of itself and the entities it operates, controls or owns.
Access to SJGHC’s free Wi-Fi system (Guest Wi-Fi) is subject to the following terms and conditions which may be revised and changed from time to time (Terms and Conditions).
If you do not agree to comply with the following Terms and Conditions, you will not be provided access to the Guest Wi-Fi.
Access to the internet through Guest Wi-Fi is provided by external internet service providers with which SJGHC has contracted (Suppliers). Neither SJGHC nor its Suppliers monitor or have control over the information available on the internet and is not responsible for its content or availability. SJGHC and Suppliers Providers expressly disclaim any liability or responsibility arising from access to, or use of, information obtained through electronic information systems, or any consequences arising from such access or use.
The Guest Wi-Fi is intended to be used in a manner that shall not cause offence or disruption to others.
Usage of internet through Guest Wi-Fi to persons under the age of 18 is at the responsibility of their parent or guardian.
Logging in and out of Guest Wi-Fi
In order to use Guest Wi-Fi, you will require a wireless enabled device with an ability to use a browser that has its own power source. You must be the lawful owner or hold the express consent for use of the lawful owner, of the wireless enabled device. You must agree to accept these Terms and Conditions of use by selecting 'Accept'.
You will automatically be logged out of Guest Wi-Fi if any of the following occur:
- your access is terminated by reason of a breach of these Terms and Conditions;
- the wireless connection of the Guest Wi-Fi you are accessing is lost, disconnected or becomes out of range;
- no activity is detected from your wireless enabled device for a continual period of 60 minutes while logged on to the Guest Wi-Fi;
- you exceed the time limit of four hours;
- you exceed the data limit of 250 Megabytes;
- you attempt to manipulate or bypass any limitations of the Guest Wi-Fi;
- we are unable to determine the IP address of your device; or
- there is an emergency.
To stop using the Guest Wi-Fi, you simply need to disconnect from the Guest Wi-Fi network in your mobile device settings.
Once you are logged-out of the Guest Wi-Fi, you will need to log-in again to regain access to the Wi Guest Wi-Fi. SJGHC cannot guarantee that you will be able to log back in to the Guest Wi-Fi immediately.
Terms of use
You agree to:
a. comply with applicable laws when using the Guest Wi-Fi;
b. not infringe the intellectual property rights of any third party in connection with the use of the Guest Wi-Fi;
c. not collect or harvest any information or data from any Guest Wi-Fi or systems or attempt to decipher any transmissions to or from the servers running any Guest Wi-Fi;
d. not use the Guest Wi-Fi to transmit, send, receive, publish, post, distribute, disseminate, encourage or solicit receipt of, upload, download or use any material which is offensive, abusive, defamatory, indecent, obscene, unlawful, harassing or in breach of any other right of any other person;
e. not use the Guest Wi-Fi for commercial purposes;
f. not use the Guest Wi-Fi to send unsolicited emails;
g. not use the Guest Wi-Fi to transmit, store, publish or upload any electronic material which is known or is likely to cause, damage or destroy or limit the functionality of any computer software, hardware or telecommunications equipment; and
h. not use the Guest Wi-Fi to invade the privacy of another person, cause annoyance, inconvenience or needless anxiety to another person.
Information on the internet
SJGHC does not guarantee the quality or accuracy of the information on the internet. It is your responsibility as a user of the Guest Wi-Fi, to determine the validity, quality and relevance of the information obtained.
Speed and reliability of the Guest Wi-Fi
Our Suppliers will use their best efforts to ensure stable and secure access to the Guest Wi-Fi, but do not guarantee that the access will always be free of errors, virus, interception or interference. Neither SJGHC nor its Suppliers guarantee that the Guest Wi-Fi will deliver continuous, fault-free or accessible connection.
If you are downloading data and you are automatically logged out of the Guest Wi-Fi then such data may not be recoverable or saved and neither SJGHC nor its Suppliers shall be liable for any such loss of data or continuity. It is recommended you do not access sites where you disclose private or sensitive information, and regularly save your work.
Upon becoming aware of any malfunction of the Guest Wi-Fi and its Suppliers will attend to rectification of the fault, but are not obliged to do so within any specified time frame.
Inappropriate behaviour
SJGHC intends for the Guest Wi-Fi to be used in a manner that does not offend the standards of the general community and SJGHC. SJGHC or its Suppliers may in their absolute and sole discretion, limit or block websites that do not meet those standards. Unacceptable websites may include, but are not limited to, websites and/or content that:
- could cause SJGHC to breach of any law, code or instrument which governs its conduct, or to incur a liability to any third party;
- could interfere with the integrity and/or performance of the Guest Wi-Fi, or its suppliers’ network or equipment;
- depicts, alludes to, or promotes offensive or illegal behaviour;
- promotes racism, bigotry, hatred or physical harm to any group or individual;
- harasses or discriminates against or advocates harassment of or discrimination against another person, or causes another person annoyance, inconvenience or needless anxiety;
- exploits people in a sexual or violent manner;
- contains nudity, violence or offensive subject matter or which may connect to adult websites;
- promotes conduct that is abusive, threatening, obscene or defamatory;
- intentionally infringes copyright;
- involves the transmission of junk mail, chain letters, or unsolicited mailing, instant messaging or spamming;
- promotes criminal activity;
- contains viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, interfere or intercept access; and
- furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
- results, or could result in damage to property or injury to any person;
- could damage, disable, overburden, impair or compromise our (or any other person's) network, systems, security or equipment;
- collects or harvests any information or data from any service or systems or attempts to do those things or to decipher any transmissions to or from any service or systems; or
- uses sexually suggestive imagery or any other inappropriate, misleading or deceptive content;
- or to collect or harvest any information or data from the Guest Wi-Fi or our systems or attempt to decipher any transmissions to or from the servers running the Guest Wi-Fi.
- could reflect poorly on the reputation of SJGHC.
If SJGHC becomes aware that websites are accessed in contravention of these Terms and Conditions, it reserves the right to immediately terminate and block the access without prior notice.
Users should be aware that the browsing or downloading of illegal information from the internet could lead to prosecution
SJGHC asks that parents supervise their children at all times while online
Access to and use of websites and/or content is also subject to such websites and/or content passing through SJGHC’s firewalls, anti-virus and other managed security systems, which are determined and set in SJGHC’s sole discretion.
Security
SJGHC does not guarantee the security of Guest Wi-Fi at all times. Your access and use of the Guest Wi-Fi is at your own risk. The onus is on you as user, to ensure that usernames, passwords and security-based information are kept private and the firewalls are installed to prevent unauthorised access.
Without limiting any other provisions of these Terms & Conditions, SJGHC shall not, in any way, be liable to you for any kind of loss or damage incurred as a result of your use of the Guest Wi-Fi, including but not limited to any viruses you may become subject to during your use of the Guest Wi-Fi.
The Guest Wi-Fi is open and public. It is recommended that you don’t send or receive sensitive personal information or carry out activities like Internet banking.
SJGHC strongly recommends you install a personal firewall on your wireless enabled device to block unwanted traffic to, access to and/or downloads to your device.
Privacy
SJGHC is committed to safeguarding personal privacy. It recognises that individuals have a right to control how their personal information (as that term is defined in the Privacy Act 1988 (Cth)) is collected and used.
If you agree to these Terms and Conditions and access the Guest Wi-Fi, you consent to SJGHC collecting, using, disclosing and processing information, some of which may contain your personal information.
It may also include information about the web browser type and/or operating system information used by the enabled device in order to determine the most effective and/or customised means of displaying the requested website on your device.
Our Suppliers may collect and store the IP and MAC address of the enabled device that has accessed the Guest Wi-FI, once the Terms and Conditions have been agreed to and may share this information with SJGHC.
SJGHC collects your personal information to generate reports which can be used by our marketing, fundraising and operations teams for promotional, marketing, fundraising, publicity, research, operational and profiling purposes. By accessing the Guest WiFi you consent to SJGHC using your supplied personal information, and location statistics for promotional, marketing, publicity, research, operational and profiling purposes in accordance with the SJGHC Privacy Policy. If you opt out, SJGHC will not use your personal information for the purpose set out in of this paragraph.
You may choose not to receive direct marketing communications from SJGHC at any time by contacting SJGHC:

- in writing to Marketing Department, St John of God Health Care, PO Box 5753, St Georges Terrace, Perth WA 6831.
SJGHC is not in any way responsible for how any third party (including but not limited to any website that you access and/or use through the Guest Wi-Fi) collects and/or uses your personal information. You are solely responsible for checking the terms of use and/or privacy policy of each website you visit and determining whether you accept such terms of use and/or privacy policies. Release and indemnity
By using the Guest Wi-Fi, you release and discharge SJGHC from any liability which might arise from the use of the Guest Wi-Fi including liability in relation to defamatory or offensive material or any breach of the copyright which may occur as a result of use.
You agree to indemnify and must defend and hold harmless SJGHC, its directors, officers, employees, agents and contractors from and against:
- all loss, damage, liability, charge, expense (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind arising from your breach of these Terms and Conditions
- all loss of profit, revenue, data or opportunities arising from or in connection with your use of the Guest Wi-Fi.
